Loan Signing Agent Certification Background Screening Requirements
In 1999, congress passed The Gramm-Leach-Bliley Financial Services Modernization Act (Gramm-Leach, 15 U.S.C. §§ 6801-6809) which in part, outlined that any person having access to personal financial information such as with loan documents pass a background check prior to gaining access to such information. Since Certified Notary Loan Signing Agents handle these types of documents, compliance with this law requires that the notary complete a background check as well.
Unlike some states, notaries for the state of California are required under California legislation to complete a background check prior to receiving a commission; consequently, notaries commissioned on behalf of the State of California automatically meet this requirement. The background clearance is currently carried out through the Department of Justice, state of California.
